Contract Terms and Waiver
Please familiarize yourself with the following policies and waivers as they relate to Movimiento's contract terms and liability protections. These policies apply upon your enrollment in our programs.
WAIVER AND RELEASE OF LIABILITY
I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released.

I certify that I/my child is physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
CONTRACT TERMS

PARTIES TO THIS AGREEMENT
This agreement is between Tutor: Ashley Counterman and Students
The Tutor shall provide instruction in the subject of Spanish at the following location: Virtual / In-person.
1. FEES PAYABLE TO THE TUTOR
Fees are calculated at a rate of $50 per hour. No additional fees shall be charged for travel, preparation time, or materials.

The Tutor may adjust fees from time to time, with changes taking effect after providing the Student/Parent with seven (7) days written notice.

2. PAYMENT TERMS
Payment is due prior to the first lesson. Payments can be made at movimiento.online

3. SCHEDULE OF LESSONS
Tutoring at the rate of $50 per hour. Sessions will be mutually agreed upon by the Tutor and Student/Parent before scheduling. Typical schedule: Weekly on a TBD day for one hour. Both Student/Parent and Tutor agree to flexibility with scheduling.

4. CANCELLATION & RESCHEDULING
Family emergency or sickness: Session may be canceled up to 1 hour before without charge; prepayment may be applied to a future session.
All other cancellations: Must be made at least 24 hours in advance.
Failure to give sufficient notice or attend will result in the session being forfeited and payment still required.
Rescheduling will be accommodated as the Tutor’s schedule allows.
5. LATE ARRIVAL & SCHEDULE CHANGES
Fees are based on the scheduled session time. No adjustment will be made for time lost due to the Student’s late arrival or early departure. The Tutor will wait 15 minutes past the scheduled start time for the Student to arrive before considering the session canceled without sufficient notice, subject to the cancellation policy.
If the Tutor is late, the lost time will be made up by mutual agreement.
6. OBLIGATIONS OF THE TUTOR

Prepare lessons in advance to optimize student learning.

Keep all Student information confidential.

Contact other parties regarding the Student’s education only with written consent.

Not assign duties to a third party without written permission.

Not complete homework or assignments on behalf of the Student.
7. OBLIGATIONS OF THE STUDENT

Communicate specific problem areas to the Tutor.

Provide necessary materials (e.g., paper, pencils).

Complete assignments, exercises, and homework on time.
8. NO WARRANTIES
The Tutor makes no guarantees regarding improvements in academic performance as a result of tutoring.
9. STATUS OF THE TUTOR
The Tutor is engaged as an independent contractor, not an employee. The Tutor is responsible for their own insurance, tax filings, and statutory contributions.
10. TERMINATION
Either party may terminate this agreement at any time with seven (7) days prior written notice.
11. RELAXATION OF TERMS
No waiver or indulgence by either party shall prevent enforcement of any rights under this agreement or be deemed a waiver of future breaches.
12. WHOLE AGREEMENT
This agreement constitutes the entire understanding between the parties regarding tutoring services. Any changes must be made in writing and signed by both parties.
